The Management Board of PCC Rokita Spółka Akcyjna with its registered office in Brzeg Dolny (hereinafter: "Company", "PCC Rokita"), acting in accordance with art. 17 sec. 1 of Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 2014 on market abuse (market abuse regulation), referring to the Company's current report No. 4/2019 of 25 January 2019 in the case of litigation with HH Technology Corp., 500 Cummings Center STE 3470 Beverly, MA 01915, United States of America (hereinafter: "HH Technology"), informs that on 30.01.2019 it received from the Company's representative the decision of the District Court in Wrocław ("the Court") of 28/01/2019, which the General Court dismissed in its entirety the application filed by HH Technology against PCC Rokita for a cessation of patent infringement no. 210255 "Manufacture of alkoxylators and devices for this method".
According to the justification of the order, HH Technology did not substantiate the patent infringement, and did not submit any reliable measures allowing the company to use the patented technology unlawfully by selling the invention on Polish and foreign markets. Thus, it is not possible to accept that PCC Rokita obtains an unfair advantage over entities which have bought a license to use the invention or HH Technology from HH Technology.
In the opinion of the court, the concern of HH Technology for future satisfaction is not justified in the circumstances of the case, nor can it be considered as real. Moreover, according to the Court, it should be pointed out at the same time that the above does not prejudge the validity of the request in the present case. The truth and validity of the claims made by HH Technology and the final legal assessment of the case will be resolved by the Court in the final judgment of the case, issued in particular after becoming acquainted with the position of the Company, its pleas and after taking evidence.
HH Technology will be entitled to appeal against the Court's decision.
