"TELSAT" Grzegorz Kawka with headquarters in Gryfice, TELWAY Sp. z o.o. based in Liszki, Trax elektronik A.Moryc, M.Tomecki, L. Turczyński sp. jawna, with its registered office in Krakow and APM PRO Sp. z o. o. with headquarters in Bielsko - Biala, and the State Treasury - General Director of National Roads and Motorways with headquarters in Warsaw, proceedings leading General Directorate for National Roads and Motorways, Branch in Lublin.
The subject of the contract is: integration of the elements of the Traffic Management System on the S12, S17 and S19 expressway - the National Traffic Management System and design works and construction works related to the construction of the task titled "Integration of the elements of the Traffic Management System on the S12, S17 and S19 expressway - National Traffic Management System". The contract value is PLN 37 358 273.46 gross (in words: thirty seven million three hundred fifty eight thousand two hundred seventy three zlotys 46/100), i.e. PLN 30 399 002,00 net (in words: thirty million three hundred ninety nine thousand two zlotys 00/100).
The deadline for completion of the work in the field of the implementation of the subject of the contract has been set at 19 months from the date of the contract.
The period of provision of the service related to the operation and management of the Integrated Traffic Management System (hereinafter referred to as IMS) and the provision of the Personnel Development Service has been defined for 48 months from the date of signing the final acceptance protocol.
WASKO S.A. will provide within the subject of the contract a six-year guarantee calculated from the date indicated in the final acceptance report.
The contract provides for, among others the following contractual penalties:
1) in the event of withdrawal from the contract due to reasons attributable to the Contractor, the Contractor shall pay the Ordering Party a contractual penalty of 15% of the maximum gross remuneration specified in the contract,
2) in the event of a delay in the execution of the whole subject of the order or individual stages of the subject of the contract in relation to the dates specified in the contract, the Contractor shall pay the Contracting Authority a contractual penalty in the amount of 0.02% of the maximum gross remuneration for each started day of delay,
3) in the event of delay in removing defects found at the appropriate acceptance or within the framework of the warranty, the Contractor shall pay the Ordering Party a contractual penalty in the amount of 0.02% of the maximum gross remuneration for each commenced day of delay in relation to the designated date,
4) in each case if the Contractor fails to achieve the SLA parameters required in accordance with the SLA, the Contractor shall pay the Ordering Party a contractual penalty calculated according to the mechanism for calculating Penalty Points and contractual penalties specified in the contract.
In the contract, the Ordering Party reserved the right to claim supplementary compensation up to the amount of damage actually suffered.
Signing the contract is the result of selecting the consortium's offer as the most advantageous in an unlimited tender organized by the General Directorate of National Roads and Motorways with headquarters in Warsaw, the proceedings leading General Directorate for National Roads and Motorways Division in Lublin for the task titled Integration of the elements of the Traffic Management System on the S12, S17 and S19 expressway - the National Traffic Management System, as reported by the Issuer in the current report No. 25 of 20/07/2018.
